1. DEFINITIONS

1.2 “Company” refers to Smart Edu Hub and its associated entity Smart Exam Resources.
1.3 “User” / “Buyer” refers to any individual purchasing or accessing products from the Platform.
1.4 “Products” refer to all digital educational resources sold on the Platform.

2. ACCEPTANCE OF TERMS

2.1 By accessing or purchasing from the Platform, the User irrevocably agrees to be bound by these Terms & Conditions.
2.2 If the User does not agree, they must refrain from using the Platform.

3. NATURE OF SERVICES

3.1 The Platform provides digital educational content only.
3.2 All Products are delivered electronically via a downloadable link sent to the Buyer’s registered email address.
3.3 No physical goods shall be delivered under any circumstance.

4. NO REFUND POLICY (STRICT)

4.1 Due to the intangible and non-returnable nature of digital products, all sales are final.
4.2 No refunds, cancellations, or exchanges shall be entertained under any circumstances, including but not limited to:

Change of mind
Accidental purchase
Lack of usage
Dissatisfaction with content

4.3 By completing a purchase, the Buyer expressly waives any right to dispute or claim a refund.

5. INTELLECTUAL PROPERTY RIGHTS

5.1 All Products are the exclusive intellectual property of Smart Exam Resources.
5.2 The User is granted a limited, non-transferable, non-exclusive license for personal use only.
5.3 The following actions are strictly prohibited:

Sharing, distributing, or forwarding content
Uploading content to public or private platforms
Reselling, reproducing, or modifying content

5.4 Any breach shall result in immediate termination of access and may lead to legal action, including claims for damages.

6. ACADEMIC DISCLAIMER

6.1 All resources are created by qualified subject experts.
6.2 Content is prepared with reference to relevant syllabi and mark schemes.
6.3 However, the Company does not guarantee absolute accuracy or examiner agreement.
6.4 The Company shall not be held liable for any differences in academic opinion, grading outcomes, or interpretations arising from the use of the resources.

7. DELIVERY POLICY

7.1 Products shall be delivered via a download link to the Buyer’s email inbox.
7.2 While delivery is generally immediate, delays may occur due to technical issues or system errors.
7.3 Such delays shall not constitute a breach of contract and must be reasonably tolerated by the Buyer.

8. TECHNICAL ISSUES & SUPPORT

8.1 In rare cases where the Buyer does not receive the download link, the Buyer must notify the Company promptly.
8.2 The Company shall make reasonable efforts to re-deliver the Product upon verification of purchase.
8.3 Failure by the Buyer to report issues in a timely manner may result in delayed resolution, for which the Company shall not be liable.

9. BUYER RESPONSIBILITIES

9.1 The Buyer must provide a valid and functional email address at the time of purchase.
9.2 The Buyer is responsible for checking spam/junk folders before raising a complaint.
9.3 The Company shall not be responsible for delivery failures due to incorrect email information provided by the Buyer.

10. LIMITATION OF LIABILITY

10.1 To the maximum extent permitted by law, the Company shall not be liable for:

Any indirect, incidental, or consequential damages
Academic outcomes or examination performance
Delays caused by technical disruptions beyond reasonable control

10.2 The Company’s total liability, if any, shall not exceed the amount paid for the Product.

11. TERMINATION

11.1 The Company reserves the right to suspend or terminate access to any User found violating these Terms.
11.2 No refund shall be issued in such cases.

12. MODIFICATIONS

12.1 The Company reserves the right to modify these Terms at any time without prior notice.
12.2 Continued use of the Platform constitutes acceptance of updated Terms.

13. GOVERNING LAW

13.1 These Terms shall be governed by and construed in accordance with the laws of India.
13.2 Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
